Claim Culture And Our Paranoid Sense Of Safety

Claim culture exists today because we live in a litigious society. And we live in a litigious society because there are too many lawyers chasing a limited number of cases. Unlike the American medical association which puts a cap on the number of medical students can enter medical school each year there is no limit to numbers of lawyers who are released into the public each year.

Medical schools are allowed only a fixed number of students per year. The American medical association controls the number of doctors graduated each year. But law schools say the more the merrier. Especially if you have the cash for the tuition. So with so many lawyers out there trying to make a buck there are a lot of law suits going around.

The lawyer needs to pay his or her office rent and pay the legal staff. So if there is any chance of a win or at least a settlement the lawyers will tell their clients to go for it. This is a means of survival. Remember decades ago the legal profession was a way to make a lot of money. It still is for some but the average wage for the average lawyer is less than 45 thousand a year.

The lawyer is more or less a negotiator. He or she tells the opponent that if they give them some money they will drop the suit. He of course wants the largest settlement because he gets a percentage. And his rent is due and he has to pay his office staff.

Does this mean that the legal system we have in place is wrong. Not entirely. You can go to some countries and find broken staircases in apartment buildings or unsafe walkways in business properties like restaurants. If you fall or slip and injure yourself, well too bad you should have been more careful. A claim culture society does all it can do to prevent the accident in the first place.

You might have to put up with silly warnings on products like knives that warn against using the product on your body because the edge is very sharp and you could be injured. But this is to make sure the company has protected itself if some sues them by saying they did not know the knife was dangerous when used in an improper manner.

In this country people who own the buildings do not want people throwing things out the window or themselves for that matter. In Europe you are free… To throw whatever you want onto the street below including yourself. And you can go to restaurants or super markets and take a fall. Who do you blame? Yourself you should have been more careful clumsy!

But then again we have a safer society to live in. When everyone is afraid of getting sued, the paranoia that ensues just might be the reason we have less accidents than if people fell down and had only themselves to blame.
